A special court in Ghaziabad today rejected the bail application of Rajesh Talwar, the main suspect in Aarushi and Hemraj murder case.
Minutes after this, his counsel Satish Tamta moved the District and Sessions court in Ghaziabad for the same, which posted the matter for hearing on June 26.
Special Magistrate for CBI cases Sapna Mishra observed that the sessions court was competent to take up the bail matter of Talwar, who is at present in judicial custody, as he had been charged with sections 302 (murder) and 201 (destruction of evidence).
Talwar was arrested by the Noida Police on May 23 which claimed that the he had murdered his daughter Aarushi and domestic help Hemraj after finding them in an "objectionable position".
However, with the Noida Police being accused of improper investigation, the case was transferred to the CBI which began its probe on June one. The CBI also questioned Talwar after taking his remand from court.
Immediately after having been denied to hear the bail plea, counsel for Talwar moved the court of District and Session Judge Narendra Kumar with a bail plea stating that his client was "innocent". The court posted the matter to June 26 for hearing.
The counsel sought bail on humanitarian grounds stating that his client had just met with a major tragedy in his daughter's death.
